Scope of Services

Cheetah provides a GTM intelligence platform that includes context graph construction, AI agent architecture, integration services, and ongoing platform access. Our services help organizations build unified knowledge layers that power intelligent sales and marketing automation. Specific deliverables and scope are defined in your individual service agreement.

Use of Our Services

By using Cheetah, you agree to:

  • Provide accurate information during onboarding and maintain current account details.
  • Use our platform only for lawful business purposes in compliance with applicable regulations.
  • Maintain the security of your account credentials and notify us immediately of any unauthorized access.
  • Not attempt to reverse engineer, decompile, or extract proprietary algorithms from our platform.
  • Not use our services to send spam, harvest data without authorization, or engage in fraudulent activities.

Intellectual Property

You retain full ownership of your business data and the context graph we build for you. Cheetah retains ownership of our platform technology, algorithms, and general methodologies. Any custom agent workflows or configurations developed during your engagement are yours to keep. We may use anonymized, aggregated learnings to improve our platform, but never in ways that could identify your specific data or strategies.

Confidentiality and Data Security

We treat all client data as confidential. Your CRM data, communication patterns, and sales intelligence remain strictly protected. We implement enterprise security standards including encryption at rest and in transit, access logging, and regular penetration testing. Detailed security practices are outlined in our Privacy Policy.

Payment Terms

  • Pilot engagements require payment upon signing, with clear milestone deliverables.
  • Platform fees are billed monthly or annually based on your agreement.
  • Retainer services for ongoing agent architecture are billed in advance each month.
  • Invoices are due within 30 days of receipt. Late payments may result in service suspension.
  • All fees are non-refundable except where required by law or specified in your agreement.

Service Availability

We target 99.9% platform uptime and provide advance notice for scheduled maintenance. While we strive for continuous availability, we do not guarantee uninterrupted service. Service credits may be available for extended outages as specified in your service agreement. We are not liable for disruptions caused by factors outside our control, including third-party integrations, internet connectivity, or force majeure events.

Limitation of Liability

Our platform provides intelligence and recommendations to enhance your GTM operations, but we do not guarantee specific business outcomes. We are not liable for indirect, incidental, or consequential damages. Our total liability is limited to the fees paid in the twelve months preceding any claim. We provide our services on an "as is" basis without warranties beyond those explicitly stated in your service agreement.

Termination

Either party may terminate with 30 days written notice, subject to any minimum commitment in your agreement. Upon termination, you may request a full export of your context graph and data. We will retain data for a reasonable transition period, after which it will be securely deleted. Fees for services rendered through the termination date remain due.

Governing Law

These terms are governed by the laws of the State of California. Any disputes will be resolved through binding arbitration in San Francisco County, except for claims seeking injunctive relief. Both parties agree to attempt good-faith resolution before initiating formal proceedings.

Changes to Terms

We may update these terms to reflect changes in our services or legal requirements. Material changes will be communicated via email at least 30 days in advance. Continued use of our services after changes take effect constitutes acceptance of the updated terms.
